Right of Cancellation for Consumers
(A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity.)

Right of Cancellation
You have the right to cancel this contract within 14 days without stating a reason. The cancellation period is 14 days from the day
- on which you, or a third party nominated by you who is not the carrier, took possession of the goods, provided you ordered one or more items as part of a single order and they are delivered together;
- on which you, or a third party nominated by you who is not the carrier, took possession of the last item, provided you ordered several items as part of a single order and they are delivered separately;
To exercise your right of cancellation, you must inform us (MäxFashion - Proprietor: Axel Schmitz, Hauptstr. 32, 50259 Pulheim, telephone: 02238 2205, email address: info@maexfashion.de) of your decision to cancel this contract by means of an unambiguous statement (e.g. a letter sent by post or an email). You may use the attached model cancellation form, although this is not mandatory.
You may also exercise your right of cancellation using the electronic cancellation function (cancellation button) provided on our website.
We provide an online form for this purpose through which you can declare your cancellation. After submitting the form, you will receive confirmation of receipt of your cancellation on a durable medium (e.g. by email).
To meet the cancellation deadline, it is sufficient for you to send notification that you are exercising your right of cancellation before the cancellation period expires.
Consequences of Cancellation
If you cancel this contract, we must reimburse all payments received from you, including delivery costs (except for additional costs arising because you selected a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive notification of your cancellation of this contract. We will make the reimbursement using the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you incur any fees as a result of this reimbursement.
We may withhold reimbursement until we have received the goods back or until you have supplied evidence that you have returned the goods, whichever occurs first.
You must return or hand over the goods to us or to Hauptstr. 32, 50259 Pulheim without undue delay and in any event no later than 14 days from the day on which you notify us of the cancellation of this contract. The deadline is met if you dispatch the goods before the 14-day period has expired.
You bear the direct cost of returning the goods.
You are liable for any diminished value of the goods only where that loss in value results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Grounds for Exclusion or Expiry
The right of cancellation does not apply to contracts
- for the supply of goods that are not prefabricated and whose production is governed by an individual choice or decision by the consumer, or that are clearly tailored to the consumer’s personal needs;
- for the supply of goods that are liable to deteriorate or expire rapidly;
- for the supply of alcoholic beverages whose price was agreed when the contract was concluded, but which cannot be delivered earlier than 30 days after conclusion of the contract and whose current value depends on market fluctuations beyond the entrepreneur’s control; - for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.
The right of cancellation expires prematurely for contracts
- for the supply of sealed goods that are unsuitable for return for reasons of health protection or hygiene if the seal was removed after delivery;
- for the supply of goods that, after delivery, have become inseparably mixed with other goods due to their nature;
- for the supply of audio or video recordings or computer software in sealed packaging if the seal was removed after delivery.
